It is another important day for privacy scholars and European citizens: today, the European Parliament finally approved the new EU data protection rules.

Opinion of the WP29 on the Privacy Shield

At a press conference in Bruxelles today, Isabelle Falque-Pierrotin presented the position of the WP29 on the Privacy Shield.

 

The common position is divided in 2 documents:

 

1. the Opinion 1/2016 on the EU-US Privacy Shield Adequacy Decision;

 

2. the working document 1/2016 on the justification of interferences with the fundamental rights to privacy and data protection through surveillance measures when transferring persona data (European Essential Guarantees).

 

The WP29 has welcomed the significant improvement brought by the Privacy Shield compared to the Safe Harbor decision (definitions, rights, framework of the transfer, more transparency, etc.), but the Group underlines that there are still few points of concerns and needs for clarification both on the commercial and the national security side.

The WP29 suggests to further improve the adequacy decision in order to assure that the protection offered under the "Shield" is essentially equivalent. 

‎GDPR: Council adopts position at first reading

The Council of the European Union adopted its position at first reading on data protection reform.

The European Parliament's Civil Liberties, Justice and Home Affairs Committee will vote again on April 12, while the approval of the European Parliament is expected for next April 14, during the plenary session in Strasbourg.

Aftherwards, the legal text will be published in the Official Journal.
